CITY COUNCIL MEETING OCTOBER 23 PUBLIC COMMENT: <br />A1 Sands, 2612 Aldine, Roseville, MN. 55113 <br />I WANT TO CALL YOUR AND THE PUBLIC'S ATTENTION TO A DRAFTING <br />ERROR IN THE CITY'S ORDNANCES DEALING WITH LAND USE IN THE B-6 <br />ZONE. (Map) <br />Note that the Twin Lakes Map, a planned PUD with and underlying B-6 zone <br />upon completion of a PUD, is the City's current ComprehensivePlan for this area. Also <br />note the "service rnix" in the lower left hand comer of 15 acres. Then also note what is <br />expected to go into this area by reference to the description on the Map: Hotels, <br />dayea,re, fitness, bank, and restaurant mix. Especially note the reference to "mix". <br />Then, going to the Zoning ordnance at 1005.07 (C), there is no similar item listed <br />as a permitted use. Instead item C. 9lists "retail". That is the drafting error I refer to. <br />By listing it as "retail", the courts seem to say that any type of retail, and to any extent, <br />can be a permitted use. The city has to be more specific in its zoning ordnance; otherwise <br />we could wind up with another shopping center, or big box, instead of the intended <br />"service m�". <br />Also, in Ordnance 1005.015, some items that would fit well in a"service rnix" are <br />not listed, and some items that I think are a bad fit, are listed. Since this requires a PUD, <br />all items listed need to be so restricted. Restaurants apparently do not require a PUD. <br />
