LAKES CONDEMNATION <br />FILE NO.: 9987-20 <br />DATE: NOVEMBER 17,2006 <br />The City's November 20t�' Study Session Agenda requests a discussion of issues that impact <br />the condemnation of properties in the Twin Lakes Area. The issues for discussion seem to be <br />the same, or at least similar to, the issues we spoke of in our attomeylclient conference on <br />October��"". As you recall, we requested that communications regarding this issue be held in a <br />closed meeting to protect the City from the use of such information later in the condemnation <br />process. We continue to believe that is a necessity. <br />You may recall at that meeting that I imparted to you the necessity of continuing to use the <br />present Redevelopment Contract originally entered into in this matter. That Contact may, and <br />most likely will, be amended, but it must continue to be the operative document between the <br />City and the Redeveloper. <br />It is my understanding that the land use applications have been amended so that the <br />Redeveloper is the applicant. If such applications are approved, then the existing Contact <br />should be modified to reflect these changes. <br />I have no opinion regarding the "Twin Lakes Summit" proposal. My only concern would be any <br />discussion publicly of any of the condemnation issues in an open forum. I assume that staff and <br />Council members would be reluctant to receive questions from the public to which the only <br />answer can be that the Council and staff are unable to respond to those questions in such a <br />public forum. <br />If you would like either Jim or I to be at the meeting on November 20, we would be happy to <br />appear. However, to discuss the matters on your agenda, we would need, once again, to ask <br />for a closed meeting. I would also note that there have been no changes in the status of any of <br />the condemnations since my October 23 appearance, and as a result, I have nothing to report. <br />Thank you <br />Phillip R.
