Conduct a Public Hearing to Consider 2007 Liquor License Renewals Mayor Klausing opened the Public Hearing at 6:18 p.m. Mr. Miller reviewed the Request for Council Action dated November 27, 2006, for consideration of one, off, club, and wine license renewals for the year 2007. Mr. Miller advised that staff recommended approval of all liquor license renewals; noting that the off-sale (liquor store) license currently held by Roseville Properties was not intended to be renewed, and as of January 1, 2007, the City would have one remaining off-sale license. Councilmember Kough requested information of City Attorney Scott Anderson regarding City Code provisions limiting length of time for an applicant to hold a license without being operational. After discussion, City Attorney Anderson was directed to provide a written legal opinion to the City Council following his review of State Statute and City Code. Mr. Anderson interpreted the request, and Council verified by consensus, that he would provide a legal opinion as to whether a time limit is property, and the length of time limit that could be imposed in City Code to "use or lose" liquor licenses. Mr. Anderson expressed concern that the proposed 60 days by Councilmember Kough may not allow appropriate time for the applicant to build or lease a facility; as often the license was secured prior to finalization of business operations. Mayor Klausing closed the Public Hearing at 6:2� p.m.; with no one appearing for or against. Maschka moved, Kough seconded, approval of the liquor licenses for calendar year 2007, contingent upon all required application items being submitted before the licenses may be issued; as listed on the staff report dated November 27,2006.
