REQUEST FOR COUNCIL ACTION <br />a�arCmsn�pro�ral= <br />� , <br />� ��� <br />�Aa <br />�4pp�ow��- <br />� �� <br />Date: 1 /10iO4 <br />ltem No.: 7. <br />Agenda Section: <br />ltem Description: Approval for revisions to City of Roseville Ordinance Title Four, <br />Section 405.02 <br />BACKGROUND <br />Due to the large volume of motorized vehicles traversing the City, it is recommended that City Ordinance <br />405.02 be revised to reference the need for an ordinance protecting the community from the abuse of <br />amplified sound from motor vehicles. A similarordinancehas recently been adopted by the City of St. <br />Paul and other urban communities. <br />Therefore, it is recommended that the following item be added to Section 405.02: <br />H. Amplified sound from motor vehicles: It shall be a violation of this Chapterto play, operate <br />or permit the playing, use of operation of any radio, tape player, disc player, loud speakeror <br />other electronic device used for the amplification of music or other entertainment, which is <br />located within a motorvehicle on a public street or alley, or in a commercial or residential <br />parking facility, which is audible by any person from a distance of fifty (50) feet or more from <br />the motor vehicle. When sound violating this section is produced or reproduced by any such <br />device that is located in a motorvehicle, the motor vehicle's owner, if present when the <br />violation occurs, is guilty of the violation. If the motorvehicle's owner is not present at the <br />time of the violation, the person who has dominion, care or control of the motor vehicle at the <br />time of the violation is guilty of the violation. In addition to an owner or a driver, any person <br />who controls or assists with the production, reproduction, or amplification of sound in <br />violation of this section is guilty of the violation. <br />PROPOSED ACTION <br />Approve the amendment to City Ordinance 405.2 as stated above allowing the community to be <br />better served through the control of abusive amplified sound from motor vehicles throughthe <br />issuance of administrative fines ($50.00) previously set forth by the City. <br />FINANCIAL IMPLICATIONS <br />None. <br />STAFF RECOMMENDATION <br />Allow and approvethe amendmentto City Ordinance 405.2 as stated above. <br />COUNCIL ACTION REQUESTED <br />Allow and approve the amendment to City Ordinance 405.2 as stated above. <br />�' <br />��� � <br />
