Resolution 10259 <br />Council Member Mashka introduced the following resolution, the reading of which was dispensed <br />with by unanimous consent. and moved its adoption: <br />CITY OF ROSEVILLE <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 10259 <br />A RESOLUTION AUTHORIZING EXTENSION OF DEADLINES IN THE <br />CONTRACT FOR EXCLUSIVE NEGOTIATIONS BETWEEN THE CITY <br />OF ROSEVILLE, MINNESOTA AND THE ROTTLUND COMPANY, INC. <br />FOR THE TWIN LAKES REDEVELOPMENT AREA <br />BE I"I� RESOLVED by the City Council (the "Council") of the City of Koseville, Minnesota <br />(the "City"), as follows: <br />Section l. Recitals. <br />1.01 On March 29,2004, the Council designated The Rottlund Company, Inc. ("Rottlund") <br />as the Master Developer of the'Twin Lakes Redevelopment Area ("Twin Lakes") and approved a <br />Contract for Exclusive Negotiations with Rottlund (the "Contract") which expires on March 31, <br />2005. <br />1.02 On September 27,2004, the Council determined that Rottlund had met requirements <br />in the Contract that it successfully complete certain actions by September 30,2004 relating to Phase I <br />of the redevelopment (which includes Areas 1 through 5 and 8), thereby allowing the Contract to <br />continue in effect accarding to its terms. <br />1.03 The Contract requires Rottlund to complete further actions by December 31,2004 <br />and, if such actions are completed, provides that the City and Rottlund intend to execute a <br />Redevelopment Agreement by March 31,2005. <br />1.04 At its October 25,2004 meeting, the Council declined to take action with respectto a <br />proposed amendment to the Twin Lakes Master Site Plan and preliminary plat, rezoning, and <br />General Concept Planned Unit Development Plan relating to Phase 1 of the redevelopment, as a <br />result of the City having received notification that the Minnesota Environmental Quality Board (the <br />"EQB") had received a petition pursuant to Minnesota Rules, Part 4410.11, requesting that an <br />Environmental Assessment Warksheet ("EAW) be prepared relating to the proposed <br />redevelopment. <br />
