First, as always, we appreciate <br />being considered for this assignment. I would be the attorney primarily responsible for the file. <br />Neal's specfic question relates to experience with MERA claims. I have had a number of <br />lawsuits over the years which included MERA counts. In 1995 I tried a significant MERA case <br />in Carver County District Court representing the city of Chanhassen. Larry Maloney represented <br />an extremely wealthy property owner on Christmas Lake who challenged a city road <br />project, clairning damage to the lake and traffic impacts.. The court trial lasted five + days as I <br />recall with extensive expert testimony on traffic,water quality and noise issues. There was <br />significant post trial briefing. The trial court ruled in the city's favor and dismissed the action. <br />The Court of Appeals upheld the trial court. The cite is Beddor v. City of Chanhassen 95 <br />WL296009 (Minn.App.}. Additionally, in a non-litigation setting, our firm has on a regular basis <br />for all of our cities dealt with the practical matter of addressing issues relating to the adequacy <br />of environmental review , project timing, etc. If you need any additional information let me <br />know.
