Department Approval: fi�lans �r �4��r�va1: Agenda Section: _ , �_ ��_ ��d'�r� Iter� Description: Consider an Ordinance Amending Title Four, Section 405.02 of the Roseville City Code Relating to Amplified Sound from Automobiles BACKGROUND Due to the large volume of motorized vehicles traversing the City, it is recommended that Title Four, Section 405.02 be amended relating to the need for protecting the community from the abuse of amplified sound from motor vehicles. A similar ordinance has recently been adopted by the City of St. Paul and other urban communities. Therefore, it is recommended that the following item be added to Section 405.02: H. Amplified sound from motor vehicles: It shall be a violation of this Chapter to play, operate or permit the playing or operation of any radio, tape player, disc player, loud speaker or other electronic device used for the amplification of sound, which is located within a motor vehicle on a public street or alley, in a parking lot, or in a driveway if the sound from such device is audible from a distance of fifty (50) feet or more from the motor vehicle. When sound violating this section exists, the motor vehicle's owner, if present, is guilty of the violation. If the motor vehicle's owner is not present at the time of the violation, the person who has dominion, care or control of the motor vehicle at the time of the violation is guilty of the violation. In addition to an owner or person having dominion of the motor vehicle, any person who controls or assists with the production, reproduction, or amplification of sound in violation of this section is guilty of the violation. PROPOSED ACTION Approve the stated amendment to Title Four, Section 405.02 of the Roseville City Code allowing the community to be better �� through the control of abusive amplified sound from motor vehicles through the issuance of administrative fines ($50.00) previously set forth by the City.
