REQUEST FOR COUNCII, ACTION <br />DATE: 03/28/03 <br />ITEIVI NO.: 3.h <br />DepartmentApprovaL• Manager Reviewed: Agenda Section: <br />---� �- <br />� � "_ — — � �-�� <br />Item Description: Resolution approving Agency Agreement far Minnesota Department of <br />Transportation Limited Use Permit. <br />Background: The City is currently completing plans and specifications for the construction of a <br />pathway along County Road B-2 between Lexington Avenue and the westerly City limits. This <br />project was approved by the City Council following a public hearing in June 2004. Construction <br />of this proj ect is anticipated to begin in May 2005. Two sections of the pathway are within <br />MnID�T right- of- way. State statute requires that the City obtain a Limited Use Permit (LUP) <br />for the operation and maintenance of a sidewalk facility within Mnl DOT right-of-way. <br />The pathway crosses under Snelling Avenue Bridge, and over Interstate 35W. Both sections of <br />pathway exist today, this permit formalizes the City's ownership of the pathway corridor. <br />Financial Implications: The LUP is for the purpose of constructing, maintaining and operating <br />a sidewalk within the right-of-way of Snelling Avenue (Trunk Highway No. 51) and Interstate <br />3 5 W. The costs for trail construction and maintenance have been budgeted. <br />Policy objectives: By executing the LUP, the City will be allowed to operate and maintain the <br />pathway within Mr�/ DOT right-of-way. <br />RECOMIV�NDED COUNCII, ACTION: <br />Adoption of a resolution approving a Limited Use Permit agreement between MnlDot and the <br />City of Roseville to operate and maintain the County Road B-2 Pathway within Mn1 DOT right- <br />of-way. <br />Prepared by: Debra Bloom <br />
