REQUEST FOR COUNCIL ACTION <br />DATE: 0�/11/OS <br />ITEM (, <br />Department ApprovaL• Manager Reviewed: Agenda Section: <br />,� <br />� _--- ����� ���� <br />��=� – - <br />Item Description: Consider an Ordinance Granting a Non-Exclusive Transit Stop Shelter <br />Franchise and an Ordinance Amending Certain Provisions in Chapter 107 of City Code <br />Background: In January of this year, the City Council directed staff to proceed with developing <br />— a granting ordinance for the construction of transit s�elter� with Trai�stop Minnesota, Inc. We <br />now have the draft ordinance, which has been reviewed by `l�ranstop and City staff. This <br />ordinance grants the right to construct advertising transit shelters at certain locations in the City <br />of Roseville. The granting of this franchise is subject to the terms and conditions as set forth in <br />Chapter 1207 of Roseville City Code. <br />In February, the Public Works, Environnlental and Transportation Commission approved 27 <br />locations for shelters. Shelters will be constructed at up to 20 of these locations once a franchise <br />is granted and subject to site plan approval. The Commission also approved shelter design at its <br />meeting. <br />Attached are two draft granting ordinances.(See attachments A and B) The difference between <br />them is how the franchise fee is calculated. Qne is a set percentage of gross revenue, and the <br />other is a graduated fee based on gross advertising revenue. <br />Through this process, we have also reviewed Chapter 1207 of City Code and found some <br />inconsistencies that need correcting and some requirements that would be difficult to adhere to in <br />all cases. We are requesting modifications to Chapter 1207 of Roseville City Code at this time. <br />(See attachment C) <br />Staff Recommendation: Staff recommends the Council adopt the variable fee granting <br />ordinance. Over time, as inflation affects advertising cost, this should provide the City with <br />greater franchise revenue than the fixed fee version. Staff also recommends the Council adopt an <br />ordinance modifying certain sections of Chapter 1207 Roseville City Code. <br />Recommended Council Action: <br />Motion to adopt a Grant of Non-exclusive Transit Stop Franchise to Transtop Minnesota, Inc <br />with variable franchise fees. <br />Motion to adopt an ordinance modifying City Code Title 1207, Sections 1207.08, 1207.09, <br />1207.10, 1207.11, 1207.12, 1207.18, and 1207.25. <br />Prepared By: Duane Schwartz <br />
