Attachment B. <br />GRANT OF NON-EXCLUSIVE <br />TRANSIT STOP SHELTER FRANCHISE <br />'�'Q '�'��NSTQP MINNESOTA, INC. <br />ORDINANCE NO. <br />AN ORDINANCE GRANTING TO TRANSTQP MINNESOTA, INC., A NON- <br />EXCLUSIVE RIGHT TO LOCATE AND MAINTAIN TRANSIT STOP SHELTERS <br />TN THE CITY OF ROSEVILLE <br />Purposes. The City has adopted, through Ordinance No. 1294, codified as Chapter 1207 <br />of the City Code, and by virtue of the authority of Minn. Stat. � 160.27, a Transit Shelter <br />Program providing for the grant of franchises to franchisees to erect and maintain transit <br />stop shelters in the City. <br />Section 1. Grant of Franchise. The City hereby grants to Transtop Minnesota, Inc, <br />whose principal address is 8009 ��"' Avenue South, Suite 1520, Minneapolis, MN 55425, <br />a franchise to install, repair and maintain transit stop shelters in the City on the terms and <br />conditions contained herein. <br />Section 2. General Terms. The grant of the franchise herein is subject to all their terms, <br />conditions, and requirements of Chapter 1207 of the Roseville City Code, which <br />establishes general terms governing all grants of transit shelter franchises in the City. <br />Section 3. Terms. The franchise granted hereby shall remain in full force and effect for <br />an initial period of ten (10) years from and after its effective date; provided, however, <br />that the City inay revoke the franchisee's right to use or occupy any portion of any street, <br />alley or right-of-way or other City property with si�ty (60) days written notice to <br />franchisee. Franchisee shall have the option to e�tend the franchise for up to two (2) <br />additional five (5)-year terms if, as of sixty (60) days prior to the end of the then-current <br />franchise term, (a) there exists no uncured breach of the covenants as described in <br />Section �??�?.?�.h� a� through (7}, (b) a Forfeiture and Termination Notice, as described <br />in Section 1207.25(B), has not been given to the franchisee by the City within the <br />previous twenty-four (24) months and (c) the franchisee and the City have agreed upon <br />the franchise fee to be paid by the franchisee during the applicable extension terms. <br />Section 4. Aareal��ocatiQn, The franchise granted hereunder is for such areas and <br />locations within the City as shall from time to time be approved by the City pursuant to <br />Section 1207.13. The initial locations hereby approved are stated in Exhibit A, attached <br />hereto and incorporated herein by reference. <br />
