83 Erosion Control. Prior to site grading, and before any utility construction is <br />commenced or building permits are issued, an erosion control plan must be <br />submitted for approval by the Director of Public Works andlor the Rice Creek <br />Watershed, and all erosion control actions shall be implemented, inspected and <br />approved by the CITY (Exhibit D). <br />8.4 Clean Up. The DEVELOPER shall clean dirt and debris from public streets that <br />has resulted from construction work by said DEVELOPER or DEVELOPER'S <br />CONTRACTORS, its agents or assigns. The CITY will determine whether it is <br />necessary to take additional measures to clean dirt and debris from the streets. <br />After 24 hours verbal notice to the DEVELOPER, the CITY may complete or <br />contract to complete the clean up at the DEVELOPER' S expense. <br />8.5 Utility &Drainage Easements. The DEVELOPER is responsible for creating, <br />dedicating andlor granting specific easements pertaining to public utility services, <br />site access, shared parking as approved by the City and as described in the City of <br />Roseville Public Improvement Contract, and storm water ponding and treatment <br />as approved by Rice Creek Watershed. The DEVELOPER is also responsible for <br />dedication 15 feet of right-of-way along their north property line from American <br />Street to the Snelling Avenue intersection and 10 feet of right-of-way along their <br />north properry line from Fa��view Avenue to the first Mall access east of �'ai�view <br />Avenue. <br />8.6 Public Transit and Cross Parking & Perpetual Access Agreement or Easement. <br />The DEVELOPER is responsible for creating, dedicating andlo� granting a license <br />or access ease�nentlagreement for a period of twenty (20) years to Metro Transit <br />and its successors, to remain an transit hub consistent with the City of Roseville <br />Comprehensive Plan, as described in Exhibit B of this document. <br />8.7 Roadway Improvements. The DEVELOPER hired a traffic consultant (Parsons) <br />to conducted detailed traffic analysis based on the 182,386 sq. ft. Mervyn'� <br />replacementlexpansion, which analysis indicated thatthe following improvements <br />and modifications are necessary at an estimated cost to the DEVELOPER of <br />$293,000: <br />• Eastbound TH 36/Fairvievv Avenue <br />0 <br />Optimized cycle lengths, splits and offsets <br />4 Lagging southbound left turn <br />• Westbound TH 36 Ramp/Fairview Avenue <br />0 <br />Optimized cycle lengths, splits and offsets <br />° Southbound through/left set as coordinated plan <br />4 Split phase east bound & westbound <br />° Protected only northbound and southbound left turns <br />° Lagging southbound left turn <br />.� <br />
