D. Roseville �i.irt�ier agrees that the use of Board-furnished water in Roseville shall at all <br />times be governed by the applicable rules, regulations and requirements which the <br />Board or City of Saint Paul has heretofore adopted or which ��aa� hereafter be adopted <br />from time to time for the preservation, regulation and protection of the Board's water <br />supply. Roseville also agrees to adopt the rules, regulations and requirements of the <br />Board or City of Saint Paul now in force or that may hereafter be adopted, in <br />connection with the us� of water in Roseville, and to enact such rules, regulations and <br />requirements into ordinances or otherwise make them legally effective and binding, <br />and to enact any amendments thereto adopted by the Board or the City of Saint Paul <br />within thirty (30) days after being notified of such adoption, and to adopt suitable <br />penalties for the violation of any such rules, regulations and requirements and to <br />strictly enforce such rules, regulations and requirements. This section, however, shall <br />be limited only to what use the water could be put to by �oseville's customers and in <br />no way gives the Board the right to dictate rules of operation for the Roseville water <br />system. <br />ARTTCLE 3 <br />SECTION 3.01 Water Svstem Facilities <br />A. The Board shall make investment in, construct, maintain, finance, operate, repair, <br />replace and retain title to all facilities necessary for the supply, metering, production, <br />storage and transmission of water to the Point of Delivery of �vhol�sale water to <br />Roseville. All such facilities of the Board shall comply with and conform to the <br />relevant Minnesota State Health Department and other applicable health or safety <br />requirements. <br />
