supplemental water through facilities or mains which transmit water purchased from the Board <br />shall be subject to the approval of the Board, which approval shall not be arbitrarily withheld. <br />ARTICLE 5 <br />SECTION 5.01 Connections Beyond Corporate Limits of Cit_y <br />Except as provided in Article 8, water extensions beyond Roseville city limits into other <br />municipalities, or the conveyance, sale or resale of the Board's water to any person or entity <br />located outside of Roseville's city limits, shall only be made with the Board's prior written <br />approval, which approval shall not be arbitrarily withheld, provided that the Board's approval <br />may be conditional on the other municipality agreeing to terms and conditions similar to those <br />contained in this Agreement. <br />The parties agree that the Board reserves the right to request permission to provide its <br />own water extensions through and beyond Roseville city limits and to provide a direct supply of <br />water to other communities or customers on its own. <br />ARTICLE 6 <br />SECTION 6.01 l��t�� <br />A. The rate for water sold by the Board to Roseville under this Agreement ("Rate") shall <br />be 71.0% of the lowest seasonal rate per one hundred (100) cubic feet charged to <br />retail water consumers in the City of Saint Paul if the Board modifies its rate structure <br />in any way that varies from solely a consumption basis, either on its own accord or at <br />the requirement of other governmental entities, both parties agree that the Rate will be <br />adjusted to a"new rate." This "new rate" shall not harm Roseville by increasing <br />Roseville's overall cost or harm the Board by decreasing the Boards overall revenue <br />under the contract. <br />� <br />
