Item Description: <br />����'� ''� <br />April 18, 2005 <br />Item: 3. <br />Dangerous Animal Ordinance <br />L BACKGROUND <br />This Council has discussed draft ordinances relating to dangerous animals at three previous <br />Council Meetings: <br />• February 14,2005. <br />• March 21,2005. <br />• March 28,2005. <br />II. ATTACHMENTS <br />The first attachment contains all state laws governing dogs, as you requested. <br />The second attachment is the Chie�s revised draft of a city ordinance. Her draft has been <br />revised to remove the appeal process to the City Council, as a majority of you seemed to <br />prefer. Now, the Chief`s draft also shows her preferred approach toward a city ordinance. <br />The Chief prefers a stand-alone ordinance that repeats, in part, the language cf state law but <br />then integrates within that language certain clarifying details about dangerous animals and <br />how they would be regulated in Roseville. For example, the Chief defines more precisely than <br />state law the dimensions and other requirements that must be met respecting the "suitable <br />enclosure" required for dangerous animals. <br />The third attachment is an illustration of a city ordinance that avoids repeating where at all <br />possible the language already in state law. Instead, this ordinance incorporates by reference <br />the provisions of state law and then separately sets forth the additional Roseville details to be <br />read in conjunction with state law — such as the dimensions and construction of the "suitable <br />enclosure." (Note: This ordinance needs City Attorney review.) <br />IIL ISSUES <br />Whether the Council wants to adopt any ordinance relating to dangerous dogs or animals <br />If so, whether the Council prefers a stand-alone ordinance combining state and City <br />requirements as the Chiefprefers, or an ordinance that incorporates by reference the language <br />in state law and then sets forth only special Roseville provisions to be read together with state <br />statute s. <br />
