After the informal review by the city council and staff, the applicant is responsible for a completed <br />application as set forth below. Proposals shall include a description of all direct and indirect service <br />and improvement costs to the City, School District and County caused by this project. <br />The City reserves the right to select a third party to assist in the analysis andlor management of the tax <br />subsidy process. The City Council will designate the TIF consultants. The City reserves the right to <br />employ legal, accounting, appraisal, financial, engineering architectural, and other consultants to <br />review the proposed project and its financing. The applicant shall pay the cost of such city consultants, <br />whether or not the project is constructed. <br />The applicant must hold harmless the City, its officers, employees, consultants and agents for any <br />alleged or actual violation of any securities laws, state or federal, in connection with the issuance of <br />bonds or notes for the project. The City may require a bond or appropriate insurance to assure this <br />"hold harmless" provision. <br />Before any City consideration can be given to a formal application, proposals investigated, or <br />consultant's time expended, a z�on-reft�ndable cash payment in the amount of $5,000 shall be paid to <br />the City to be used for administrative and consulting costs; any balance of such deposit will be <br />refunded after all costs are paid. The $5,000 fee shall be paid to the City at the time the application <br />and supporting data is filed. To the e�tent permitted by law, the City will allow the applicant to use <br />these costs as eligible proj ect costs for financing purposes. <br />Prior to final approval of the tax subsidy, the City Finance Director shall certify any additional costs <br />not covered by the administrative or application fees, which shall be paid to the City prior to final <br />approvals by the City. No construction shall be done prior to final approval of the tax increment <br />subsidy plan. <br />The undersigned applicant understands the approval or disapproval by the City of Roseville for tax <br />incrementfmancing does not expressly or implicitly constitute any approval, variance or waiver of any <br />provision or requirement relating to any zoning, building or other rule or ordinance of the City of <br />Roseville, or any other law applicable to the property included in this project. <br />The City reserves the right to deny any application for financing at any stage of the tax increment <br />review or hearings prior to the adoption of the final approval authorizing the issuance of the loan. <br />3 <br />
