DP'W/Ti'
scription:
REQUEST FOR COUNCIL ACTION
n.r ?
Notices (P`3634)
 _f TOPIC DESCRIPTION:
Date: 04125105
Item No. 6.
ariance
L] The Variance Board has recommended a change to the Section 1014.04 B4 of the City Code
relating to official notice prior to Variance Board hearings. The Board and staffrecommend
one written notice to property owners within 350 feet. On the notice would be the time and
date of the hearing and the process i time limits for appeals of the Variance Board
decisions.
1.? On April 6,2005, the Planning Commission held a public hearing on this proposal. There
was no public comment. The Planning Commission recommended approval 6-0, with
clari'yng language added to state that the appeal process will be explained on the mailed
notice.
I..} Current code requires the staff to send out individualizednotices before and after the
meeting. The "after meeting" notice explains the action taken by the Board and also explains
the appeal process. With the exception of the action, which can be found at the meeting, on
cable, and in minutes and on the web page, all mailed notice materials could be simplified
and reduced in expense with one "pre-meeting" mailing, 10 days in advance of the meeting.
,Q RF.'(4NaTTCV;
?. I The Planning Commission, Variance Board and the staff recommend the change as a means
of simplification and reducing the cost and time of the notice process.
3, SUGGESTED ACTION:
BY MOTION, approve of the text amendment.
Attachment: Proposed Amendment
:.i. _- iyalttyr.'Mi''ut ifirf 'J7'GFifi lyl7 TiC'fV;Ftii i':.YtifFw 1':TF. ti'+fir vJS'tiil' } a3
Ilotice_AmendmentlECA_Propased Changes to City Code (042505).doc
