City Council Study Session — 04/18/OS <br />DRAFT Minutes - Page 6 <br />municipality makes a decision, there was a court-appeal <br />procedure whether defined by ordinance or not. <br />Councilmember Maschka spoke in support of having an <br />ordinance in place, with his preference for incorporation of state <br />law into the City's ordinance, with further clarifying details <br />included. Councilmember Maschka opined his support of the <br />changes made to-date; expressing his concern regarding <br />enclosures. <br />Further discussion included Section D4 related to sterilization of <br />dangerous animals and inclusion of the word "require;" <br />implanting of microchips as a prerequisite to registration; and <br />officer discretion. <br />Councilmember Schroeder opined his lack of support for a City <br />ordinance more detailed than state statute; and questioned the <br />need for such an ordinance. <br />Chief Sletner advised that the proposed ordinance was not <br />prompted by one incident, but had been recommended through <br />police department experiences as well as attorney advice to <br />tighten up the City's ordinance related to dangerous animals. <br />City Manager Beets advised that staff would incorporate <br />tonight's comments and discussion into another revised draft of <br />the ordinance to bring before the City Council as an action item <br />to determine where the votes lie for enactment. <br />4. Review and Discuss Draft Ordinance Amending Title Three, <br />Section 311.12, Pawnbrokers and Precious Metal Dealers <br />Police Chief Carol Sletner and Sgt. Lome Rosand were present <br />to review the proposed ordinance amendment to allow Police <br />Department investigators to successfully prosecute individuals <br />who pawn stolen property. <br />Sgt.
