Determination of Status <br />(2) Exemption. An animal mav not be declared dan�erous or potentially dan�erous if <br />the threat. z�iuz�v or damage was sustainedb� a�erson: <br />�a } who was committina. at the time. a willful tres�ass or other tort u�on the <br />premises occu�ied bv the owner of the animal; <br />(b) who was provokin�, tormentin�. abusin�. or assaultin� the animal or can be <br />shown to have repeatedly, in the pas�, provoked, tormented, abused or assaulted the <br />animal: or <br />(c} who was committing or attembtin� to commit a crime. <br />This language is from Minn. Stat. §347.51, Subd. 5(modified to substitute "animal" for <br />���g���. <br />
