City Council Study Session — 07/18/OS <br />DRAFT Minutes - Page 24 <br />Mayor Klausing opined that he was not suggesting that, and <br />recognized, this was a serious issue, but that media and <br />discussion forums were creating a false impression on people <br />and raising their fears that their individual homes were at risk. <br />Mayor Klausing expressed his personal philosophy related to <br />ED, noting that he was not always in agreement with past <br />practice andlor court decisions, but that each situation was <br />unique and needed individual consideration. Mayor Klausing <br />further opined that, while he wasn't averse to having a <br />discussion, he wasn't interested in rehashing the Twin Lakes <br />proj ect. <br />Councilmember Maschka opined that the recent court decision <br />hadn't changed his mind on the use of ED and the caution he <br />maintained in considering use of ED. Councilmember Maschka <br />clarified his reaction to his perception of Mr. Houck's <br />threatening tone during his public comments. <br />Mayor Klausing concurred with Councilmember Maschka, that <br />the recent court decision had not changed his philosophy <br />regarding ED. <br />City Attorney Anderson, for reference, reviewed the Supreme <br />Court case, its intent and implications, and confirmation that <br />local governments and policy-makers use jurisprudence and <br />discretion in considering ED, on case-by-case basis, rather than a <br />general policy. <br />Councilmember Ihlan opined her desire to have a public policy <br />discussion, and move toward ordinance adoption. <br />City Attorney Anderson opined that discussion would be of a <br />legal nature to determine public purpose, and questioned what <br />right a sitting council had to dictate policy to a council elected <br />five years down the road. <br />07/25/OS Meeting Cancelled <br />Mayor Klausing noted that Councilmembers Kough and <br />Maschka would both be unavailable to attend the scheduled July <br />25, 2005 regular Council meeting, and with review with staff of <br />potential agenda items, was suggesting that the meeting be <br />7f25f05 <br />Meeting Cancelled <br />
