Environmental Remediation <br />�a� The Redevelopment Property is contaminated with certain Hazardous <br />Substances. The plans for remediating the contaminated portions of the Redevelopment <br />Property will be described in the Approved Response Action Plan. <br />(b� The City shall make available to the Redeveloper all existing reports, as- <br />sessments and other data in the possession of the City relating to the soils �,n�] environ- <br />mental conditions of the Redevelopment Property. <br />��� With respect to Parcels under condemnationwhen the City has obtained con- <br />sent from the property owner or a court order permitting inspection, the Redeveloper and its <br />agents and designees are granted permission to inspect, analyze, and test such Parcels to the <br />extent permitted by Minnesota Statutes, Section 117.041. The Redeveloper shall hold the <br />City harmless from any liability resulting from the Redeveloper or its agents or designees <br />entering upon such Parcels or �erfor-ming any of the tests or inspections referred to in this <br />subparagraph. <br />�d� The Redeveloper shall have the sole responsibilitv for Environmental <br />Remediation and soils correction and shall bear all costs associated therewith. The Re- <br />developer shall perform the Environmental Remediation pursuant to the Approved Re- <br />sponse Action Plan. The Redeveloper intends to seek a No Action Letter from the <br />MPCA, but inability of the Redeveloper to obtain a No Action Letter shall not excuse the <br />— Redeveloper from any of its obligations hereunder. <br />
