In all cases where the Permittec, by perF'nrn�ing the work authorized by this permit, shall involve the <br />taking, using, or damaging of any property rights or ir�terests of any other person or persons, or of <br />any publicly owned lands or ixnpravcmer3ts thereon or interests therein, the Permittee, before <br />proceeding, shall obtain the written consent of all persons, agencies. or authorities con�erned, and <br />shall acquire all pra�nct�y, rights and interests needed for the work. <br />8. This pen�yir is permissive only. No liability shall be imposed on the RCWI� or any of its officers, <br />agents, or employees, officially or personally, oti account of the granting hereof or on account of any <br />damage to any person or property resulting Fi�n any act or omission of the Permi#tee or any of its <br />agents, employees, or contractors. This permit shall not be construed as estopping or limiting any <br />legal claims or right of action of any pErson against the Permittee, its agents, employees or <br />contractors, for any darne�e or injury resulting from any such act or omission, 4� as estopping or <br />limiting any te�al claim ar right of action of the RCWD against the Permittee, its agents, ernployecs, <br />or contractors for violation o f or failure to comply with the permit or applicable provisions of law <br />9. The replacement wetland approved as part of this permit shall be ca�stx�w.cted concurrent or <br />prior to any wetland fill activity. <br />2. The Declaration of R�sttietions and Covenants for Replacement Wetland shall be properly <br />filed and r'ecordcd prior to any wetland 3�11 activity, with proof of recording furnished to the <br />District. <br />3. 'T�he permittee shall sub�niE a monitoring report on the replacement wetland to RCWD which <br />includes the iiqf4tm�tioz� specified in Minnesota Rules 5420.0620 ench }'Par for five years <br />following completion of the replacement wetland. The report shall be submitted no later than <br />Nove�iber� I S of each year. <br />4.
