EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL �F THE CITY OF ROSEVILLE <br />Pursuant to due call and �otice thereof, a regular meeting of the City Council of the City of <br />RosevilIe, County of Ram�ey, Minnesota, was held on the 22°� day of August, 2005, at 6:00 p.rn. <br />The folIowing mez�n.bers were present: Maschka, Ihian, Kough, Schraecler, Klausing <br />and the following were absent: None <br />Cauncil Member introduced the following resoIution and rnoved its adaption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING THE VACATION OF CERTAIN PUBLIC <br />STORM AND SEWER EASEMENT5 ON PROPERTY AT <br />200� FULHAM STREET (PF3G71). <br />WHEREAS, United Praperties has requesfied the vacation of a storm sewer easemenfi and <br />a sanitary sewer easement that lie within their westerly development in the nart�west quadrant of <br />Roselawn Avenue and FuIham Street; and <br />WHEREAS, the requested ease�nents are located on the following described property: <br />See Attachment <br />WHEREAS, the Fublic Works Department �a� determined that the requesied storm and <br />sewer easeaments, no lnnger necessary for public infrastructure (the sewer easernent will be <br />relocated and a new easement createc�}; and <br />WHEREAS, the Roseville Planning Commission held a public hearing regarding the <br />Concept Developrr�ent of the west and east sides of FuIham Street at Miclland HiIls Cauntry <br />Club, wl�ich proposal sought input on the relocation of the sanitary sewer lift station and vacation <br />of certain public easements; and <br />WHEREAS, the Planning Commission on Octaber 1, 2003, voted (5-1) to reco�nmend approval <br />of the easement vacations. <br />NOW THEREFORE BE IT RESOLVED, by the Rosevilie City Cotzncil, to grani the <br />VACATION of certain STORM & SEWER EASEMENTS on the above identifiad praperties, <br />based on the findings in Section 5 of the project report dated August 22, 2005, and subject to the <br />following conditions: <br />1. The develap�r shall sub�rt the legal description oi the easements ta be vacated <br />and the proper l�gal document on whzch to record the vacatian at Ramsey County, <br />both to be revzewed and approved by the Director of Public Works {Attachec�). <br />
