The agreement <br />is for 50 years commencing on January 1, 1993 and expiring on December 31,2043. In <br />the agreement there is a section on the parties' right of early termination. R�se�avv� <br />Cemetery has decided to exercise that option and has officially given the 5 year required <br />notice of termination. <br />The property has remained natural and is a wooded wetland area. However, as you can <br />see from the map the property is a major trail connection linking the pathway system on <br />the east side of Reservoir Woods to the pathway system on R,oselawn Avenue. The trail is <br />of asphalt surface and will need to be removed upon expiration of the lease. Since the <br />trail was constructed with federal funds there is a requirement that a pro-rated portion be <br />repaid. The portion will depend upon the number of years of use the city has received. <br />Attached for your information and review is a map of Reservoir Woods outlining the <br />leased Cemetery parcel, the lease agreement filed 1-27-93, and a letter from Edward S. <br />Reid, President of the Rase�awn Cemetery Association terminating the lease agreement <br />effective December 7,2009. <br />Staff will be prepared to review the details with you at your meeting on Monday, October <br />10 and ask for your guidance. <br />
