REQUEST FOR COUNCIL ACTION <br />DATE: 11/14/OS <br />ITEM NO. 3.1 <br />DepartmentApprova : � irt `rf:�t�=�ci :��,�„��,kaT: Agen Sect�on <br />TP/DPW �7��� b(� � �� CONSENT <br />Repair (�'F3�i8G) <br />�.� BACKGROUND: <br />],1 On October 24, the City Council continued this item so that the City Planner could <br />i�cludelprovide additional information on "major" and "minor" vehicle repair. <br />].� On February 2,2004, the Roseville City Council approvedmodifications to Section 1005, <br />Business Districts of the Roseville City Code. The intention of the proposed amendments <br />wos to clear up confusing language by removing aza.cUar amending specific text and by <br />creating a chart that included alllot requirements (1005.01) and pennittediconditional uses <br />(1005.015). <br />1. � One of the major changes that occurred was the modificationto the "definitions"section, <br />where staff attempted to provide clearer language on specific topics. However, after a <br />request, staff discovered that the changes inadvertently excluded these uses from the "USE <br />CIIART" in Section 1005.015. <br />].� Specifically, the Code includes a description of a"major and minor vehicle repair" but the <br />"use" chart does not account for either, it only accounts for a general "vehicle repair" and <br />allows it as a conditional use permit in the B-3, General8usine,ss District. <br />].5 Section 1002.02 (Definitions -Auto Repair —Minor): The replacement of any part or <br />repair of any part which does not require removal of the engine head or plan, engine <br />transmission or differential; incidental body or fender work, minor painting or <br />upholstering service to passenger vehicles and trucks not exceeding three-quarter (314) <br />ton capacity (Ord. 1286 — 08/04/03). <br />],�a Section 1002.02 (Definitions �- Auio Repair — Major) states: General repair, rebuilding <br />or reconditioning or engines, motor vehicles or trailers, including bodywork, <br />framework, welding, and painting (Ord. 1286 — 08/04/03). <br />].� The City Planner reviewed the situation with the City Attorney.
