City Council Regular Meeting —11/28/OS
DRAFT Minutes - Page 31
10. Consider Terrance Fenne's Request for a Conditional Use
Permit (CUP) at 910 W Highway 36 (PF 3691)
Community Development Director Dennis Welsch presented a
summary of the request by Terrance Fenne to construct a 1,008
square foot detached accessory structure (garage) in his rear yard
at 910 W Highway 3 6.
Mr. Welsch reviewed the proposed location of the stcture,
placed northlsouth on the lot for maximum tree preservation on
either side of the lot; and noted that the structure was the
maximum size allowed under a CUP application. Mr. Welsch
noted that the property was zoned for single-family, residential
uses, and the reason for a CUP was due to only a 6 foot depth
overage for the structure. Mr. Welsch reviewed the installation
of a new driveway to be constructed on the north side of the
property; removal of an existing shed from the site; with the
existing attached garage to be remodeled into additional living
space. Mr. Welsch advised that neighborhood impacts had been
reviewed by staff; and the Planning Commission had
recommended approval conditionally as noted on the proposed
ordinance.
Mr. Welsch addressed comments heard at the Planning
Commission level from the adjoining property owner concerning
noise, screening, size, mix of materials; and specifically
reviewed the note of opposition received from the property
owners at 911 W Sherren Street.
Councilmember Ihlan referenced the staff report, Section 6.1,
dated November 28, 2005, Section 1013.01 of City Code and
criteria used in review of a CUP; questioning whether the
Planning Commission had considered whether the size was
compatible with contiguous properties.
Mr. Welsch confirmed that the Planning Commissioner had
considered the size; the size of the overall structure; and the
actual6 foot depth requiring a CUP.
Mayor Klausing duly noted that the CUP was for the 6 foot
depth; with Mr. Fenne not being required to make application for
a CUP without that additional 6 feet on the structure; and since
Resolution 10355
Terrance `enne
CUP
910 W Highway 36
(PF 3691)
