�_0 REVIEW of REQUEST: <br />�. I Kimco Realty Corporation seeks approval of a REZONING of 1800 Highway 36 to allow <br />redevelopment into a retail building and a free standing banlc. The subj ect parcel has a <br />Comprehensive Land Use Map designation of B(Business) and an existing zoning of �3-� <br />(Limited Business District). <br />�.� The REZONING request (from B-1 to B-2) will allow Kimco to redevelop the 4.2 acre parcel <br />consisting of the former 18,480 sq. ft. Franlcs Nursery � Crafts structure and 8,000 sq. ft. addition <br />into a minimum of two new retail uses and a freestanding 7,085 sq. ft. banlc with drive-thru. These <br />redevelopment proposals in a B-2 zone are permitted uses and do not require site plan approval <br />from the Planning Commission or City Council. The submitted plans must be consistent with <br />Sections 1005 (Business Districts) and 1010 (Design Standards) of the Roseville City Code. <br />— �M. � The subj ect parcel is located directly north of Children's World Day Care which lies along <br />Fai�rview Avenue and the offices of Industrial Fabric Association and Coldwell Banlcer Bumet <br />which lie along County Road B. Directly to the east are retailers Circuit City and Sports <br />Authority. Directly to the west (across Fairview Avenue) are single family homes. To the north <br />(across the frontage road and Highway 36) is Rosedale Regional Shopping Center. <br />�,� STAFF COMMENTS: <br />�. f The former Franlcs retail/greenhause is a permitted use as a Lawn and Garden Center in the �3-t <br />District and the site received a SPECIAL USE PERMIT to allow outdoor display of inerchandise. <br />Banl�.s and financial institutions with drive-thru facilities are allowed as a CONDITIONAL USE <br />PERMIT in the B-1-B zone and are PERMITTED USES in the B-2 zone (without a conditional <br />use permit). A recent staff review of the adjacent uses and parcel zoning concluded that the Sports <br />Authorityparcel is inappropriatelyzoned. Specificallythepropertyhas a zoning ofB-1-B, <br />Limited Retail District, which zone does not allow sporting goods stores. The Circuit City use <br />(television, radio, electronics and repair) is a permitted use in the B-I-B zone. <br />�.� In September 2005 Kimco representatives met with staff to review their interest in the Franlcs site <br />and the options available (rezoning versus planned unit development) and concluded that with <br />redevelopment a planned unit development may be appropriate, but if the main Franlcs stnzcture <br />were to remain and be remodeled and the site developed with an addition and/or additional <br />structure, a rezoning would be more appropriate. <br />�. 3 In October Kimco representatives again met with staff to determine the necessaryprocess for a <br />rezoning. It was at this meeting that the City Planner discussed the rezoning options and suggested <br />the B-2 zone. This specific zone was chosen mainly because of the proposed banlc and the existing <br />adjoining Sports Authority site is a non-conforminguse in a B-1-B zone, but a use permitted <br />(sporting goods) in the B-2 zone. <br />5� Further, based on some of the desires of Kimco (cross access and storm pond modifications) there <br />could be a j oint application to rezone both parcels. However, Sports Authori,ty has not vrovided <br />an a�plication or a letter sup�ortin� the rezonin� <br />�� Sporting goods stores and banlcs are permitted uses within the B-2 zone as are a number of other <br />low to medium impact uses. <br />F�3580 RCA_121905 Page 2 of 7 <br />
