Attachment B <br />Grant No. SG007-121 <br />AMENDM�NT AND EXTENSION OF <br />N1E'Y`nOPO�ITAN L[VABLE COMMUIVIT'l�S ACT <br />LIVABLE COMMUNITIES DEMONST1tATION ACC4UNT <br />DEVELOPMENT C�ANT P'ROGRAM <br />GRANT AGREEM�NT <br />THIS AGREEME�IT is made and entered into by the Metropolitan Council ("Cauncil") �nd the <br />Ci.ty of l�os�eville ("Grantee"). <br />WHEI�EAS, on April 23, 2008 the Council and the Grantee entered into a grant agreement <br />identifed as Caunci! Grant No. SG007-1.21 under which the Catincil provided $305,000.00 in <br />Demonstratior� Accouni grant program funds ta the Grantee to support the Grantee's Har Ma�� <br />Apartments project; and <br />WH�REAS, pursuant to Pa�•agraph 4.01 af Grant No. SCr007-121 the grant agreeinent will expire <br />on its "Expiration Date" of Decem.ber 31, 2009; aild <br />WHEREAS, by e-mail correspondence dated July 31, 2009 tl�e GraE�tee requested a ai�e-year <br />extension of Cl�e gt•ant agreetnent to allaw additional time within w��icl� to camplete Che Har Ma�- <br />Apartments proje�t; and <br />VV�EREAS, p�rsu�lt to Paragr�ph 4.03 of Grant No. SG007-�21 the Expii•ation Date may be <br />extended only once and the one-time extension inay noi exceed one year beyot�d the original <br />Expiration Date ident.i�ied at Page 1 af the �rar�t agreenient; and <br />WHEREA.S, tl�e parfies mutually agree that the grant agreea��ei�t shotRld be contin�iecE and extend.eci <br />beyond� its Decernber 31, 2009 Expiration Date so tfie gran# funds ca�-► be used for their intended <br />purpose; and <br />WH.E.REAS, it is the parties expectaCion that all grant-f�inded activities as weil as fhe Har Mar <br />Apartments project itself wi11 be connpleted by December 31, 20I0. <br />NOW THE1tEFORE, pursuant to Paragraph 4.03 of Grant No. SG007-121 and in cansideration <br />of the promises a��d co�enants contained �n this a�reernent, the Council and the Gran�ee agree to <br />aineild and e�tend Grai�t No. SG007-121 as foliows: <br />The "Expiraiion Date" identified at Page 1 of the Agreenle�It and refereticed in <br />P�agraph 4.O1, Term, is cl�anged from December 3�, 2009 to December 31, 2010. <br />Except for this nlodificaiion, the provisions oF Grant No. SG007-121 sha11 remain in force and <br />effect witl�out change and Grant No. SG007-121 shall be amended as provided in this agreenzei�t. <br />Page 1 q f�2 Page.s <br />� <br />
