Attachment C <br />Grant No. SG007�143 <br />AMEI�DME�N�' AND �XTENSIOIV OF <br />METRO�'OLITAN LIVABLE COMMUNITIES ACT <br />TAX BASE 12EVITALIZATION ACCOUNT <br />GRANT AGREEIVMENT <br />THIS AGREEMENT is made aY�d entered into by the Metropolitan Council ("Council"} and the <br />City of Rosev€lle ("Crrantee"}, <br />Wi�EREAS, on April 23, 2008 the Counci! and the Grantee entered into a grant agreenient <br />identified as Council Gi'a.i�t No. SG007-1.43 under which the Council provided $121,500.00 in <br />Tax Base Revital��ation Account grant progt•am funds For asbestos and lead-based paini abatement <br />associated wilh the Crrantee Har Mar Apartments projec#; and <br />WHEREAS, ptirsuant to Paragrapl� 5.01 of Gra��t No. SG007-343 tE�e �rant agreemEnt will expice <br />on its "�xpiration Date" of December 31, 2009; and <br />WHEREAS, by e-mail correspondence cfated luly �I, 2009 the Grantee req�ested a one-year <br />extension of the grant agreement to allow additional tirne within which to complete the Har Mar <br />Apartments project; and <br />WHEREAS, p��rsuant to Paragraph 5.03 of Grant No. SGOd7-143 the Expiration Date may be <br />extetaded anly once a�1d the o�1e-tin�e extension may nat exceed one year beyond the origit7al <br />Expiration Date identified at Page 1 of the grant agreenient; a.nd <br />WHCREAS, the parties inutual�y �gree that tlle grant a�reemeilt should be continued and extended <br />beyond iis December 31, 2009 Expiration Date so t�1e bt��lt fiinds can be used for tl�eir intended <br />purpose; and <br />WHER�AS, it is C11e parties eYpect�tion �hat alE �rant-tiu�lded activities as �vell as the Har Mar <br />flpartn�ents project itself wi�l be completed by Dec�mber 31, 2010. <br />N4W THEREFORE, pursuan# to Paragraph 5.03 of Grant No. SG007-143 and in consicleration <br />of the proi�ises and cavenants coz�tained in thfs agrEei���nt, the Council and the Grantee agree to <br />amend and extend Grant No. SG007-143 as follows: <br />The "Expir-ation Date" identified at Page 1 of th.e Agreement a�d referenced in <br />Pa��agt-aph 5.01, T"erm, is changed from Decen�be�� � 1, 2009 to Decernber 31, 2010: <br />Except for this modification, the provisio�ls o�f G�ra�7t I�io. SG007-143 shall remai�i in force and <br />effect without change and Grant No. SG007-143 shall be amended as provided in this agreerr�ent. <br />Tllis amendrnent only extends the Expiration Date of the �ra��t agreement and does not authorize <br />I�CIgC' i Of 2 PCl�rG'S. <br />� <br />
