Planninq File 09-025 <br />� Request by Boater's Outlet (with property owner RECO Real Estate, LLC) for <br />.. approval of outdoor storage as a CONDITIONAL USE at 1705 County Road C <br />4 Chair poherty reviewed the purpose and process for public hearings before the Planning <br />� Commission; and opened the Public Hearing for Planning File 09-025 at 7:20 p.m. <br />E Associate Planner Bryan Lloyd reviewed staff's analysis of the request by Boater's Outlet, <br />7 with the property owner RECO Real Estate, LLC, for approval of outdoor storage as a <br />� CONDITIONAL USE at 1705 County Road C. Mr. Lloyd provided relevance via <br />� background of this use, with storage initiated in 2004, a subsequent moratorium on <br />1 C outdoor storage preventing more permanent approval at that time; a temporary Interim <br />11 Use Permit granted, and expiring three (3) years later in 2007, and continued non- <br />1� conforming use by the applicant. <br />1� Mr. Lloyd advised that staff was aware of the non-compliance, and had worked with the <br />14 applicant in resolving the non-compliance; and potential external or internal impacts. Mr. <br />1� Lloyd further advised that the Fire Department had no concern with the current outdoor <br />1E storage arrangement, ant that this arrangement was preferred by the applicant; and staff <br />17 concurred with the configuration, beyond the conditions outlined in Section 6 of the staff <br />1� report related to screening and select areas allowed for display sales as identified in the <br />1 � site plan. <br />2C Staff recommended approval of the request for a CONDITIONAL USE for RECO Real <br />21 Estate, LLC and Boater's Outlet to allow the outdoor storage of boats at 1705 County <br />2� Road C; based on the comments and findings of Sections 4 and 5 and the conditions of <br />2� Section 6 of the staff report dated October 07, 2009. <br />24 Commissioners expressed concern with the status of the expired Interim Use Permit and <br />2� other potential expirations and how staff could monitor timelines for their expiration. <br />2E Staff noted that some Interim Use Permits were temporary in nature and had ceased; and <br />27 any remaining IUP's were minimal in number (i.e., Meritex Trucking site); with others <br />2� subject to periodic review and renewal (i.e., multiple State Fair Park and Ride sites); <br />2� applicable legal issues for the City, with the applicant responsible in making application to <br />3C the City for any extensions; and no administrative extensions in place under current City <br />31 Code for the City to e�end IUP's. <br />3� Commissioners expressed concern that there was not a better process in place to monitor <br />3� those expired IUP's, opining that this was not in the best interest of the City. <br />34 Staff assured Commissioners that there was newer computer technology now in place to <br />3� allow staff to maintain an up-to-date calendar system to allow tracking of land uses, <br />3E beyond institutional memory, and to avoid similar situations in the future. <br />37 Commissioners, by consensus, encouraged staff to maintain sufficient communication <br />3� with property owners and applicants that will provide monitoring of expiration dates. <br />3� Specific to this request, discussion included use of other portions of the site for outdoor <br />4C storage of school buses; staff's identification of this as a pre-existing use, outside the <br />41 purview of this request, with no ability by the City to require additional standards (i.e., <br />4� screening) unless the property owner sought to make improvements on the lot; and <br />4� adjoining properties being industrial in nature, similarto the subject parcel, with Boaters <br />44 Outlet being one (1) tenant on the property. <br />4� Further discussion included type of storage exclusive to boats and boat trailers, but <br />4E excluding recreational vehicles and/or semi-trailer storage. <br />47 Mr. Lloyd advised that no applicant representatives were in attendance at tonight's <br />4� meeting; and further advised that staff had received no written or verbal communication at <br />4� the staff level related to public notice of tonight's hearing on this case. <br />Wth no one appearing to speak for or against, Chair poherty closed the Public Hearing <br />for Case #09-025 at 7:45 p.m. <br />Page 1 of 2 <br />
