EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 9t" day of November 2009 at 6:00 p.m. The following members were present: Roe, Pust, Johnson, Ihlan, and Mayor Klausing and the following were absent: None Council Member Roe introduced the following resolution and moved its adoption: RESOLUTION NO. 10762 A RESOLUTION APPROVING THE VACATION OF A CERTAIN PUBLIC ROADWAY EASEMENT (PF09-029) WHEREAS, the City of Roseville seeks the vacation of a certain roadway easement adjacent to Sienna Green (Har Mar Apartments); and WHEREAS, the Roseville Public Works Department in 2005 recorded a corrected legal description of the subject roadway easements; and WHEREAS, the Ramsey County Surveyor has concluded that the original easement, underlying the revised and corrected easement, needs to be officially vacated in order to record the Aeon plat for Sienna Green; WHEREAS, the Roseville Public Works Department has determined that the easement is no longer necessary for public purposes and can be vacated; and WHEREAS, said EASEMENT described below (Document 1795426 in Book 2275, Page 978, of April 13, 1971) is to be vacated in its entirety: A strip of land 50 feet in width over the following described property: Subject to STH 36/118 and STH SI/125; the South 7 acres of the Northeast Quarter (NEl/4) of the Southeast Quarter (SEI/4) of the Southeast Quarter (SEl/4) of Section 9, Township 29, Range 23, County of Ramsey. The Centerline of 50 foot strip of land described as follows: Commencing at a point 437.82 feet North of the Southwest corner of the afore described Quarter, Quarter, Quarter ('/, '/, '/4) in Section 9, Township 29, Range 23; Thence east 220 feet; Thence south 56 degrees, 59 minutes, SO seconds East for 320.62 feet, more or less, North of the South line of the afore described property and there terminating.
