Attachment A <br />MEMORANDUM O�' Z.INDERSTANbING <br />BETWEEN <br />CITY OF ROSEVILLE, MINNESOTA <br />AND AEON <br />This MEMORANDUM OF UNDERSTANDING is hereby made and ent�red into by an� <br />between the City o�Rosevil]e, "the City,"� and Aeon. <br />A. PiJRPOSE <br />The purpose of this MOU is to articulate the responsibilities af the City and Aeon in regards <br />to the implementation grants awarded to the City by the Metropolitan Council through the <br />Livable Communities Program for ihe Har Mar Apartment project. Nothing in this agreement <br />sha�l be construed as altering the terms and conditions oithe granis. <br />B. THE CITY O�' ROSEVILLE SHALL: <br />1. �'ass through grant fundi��g awarded to the City from the Metropolitan Councii's Livable <br />Communities Demonstration Account (LCDA) in the amount of $305,000 to Aeon pursuant <br />to the terms o�the grant. <br />2. Pass through grant funding awarded to the City fi•am the Metropofitan Council's Livable <br />Communities Tax Base Revitalization Accaunt (TBRA) in the amount of $121,500 fo Aean <br />pursuant to the terms of the grant. <br />C. AEON SHALL: <br />1. Undertake the scopes of work idenEi�ed in the LCDA Grant Agreement (Exhibit A) and <br />TBRA Gra�t A�reement (Exhibit B). <br />2. Be responsible to provide required project matching ftinds for the LCDA and TBRA graz�ts. <br />3. Corr3ply with a�l appl�cable state and federal laws anc! the agr�eine�t ent�red into by the City <br />of Roseville and tk�e Met�ropolitan Councii specifc to the �.CDA and TB�A grant�s. <br />4. Require contractors and subcot�tractors p�rforming work covered by the LCDA and TBRA <br />grants obtain a!I required permits, licenses and certifications, and coinply with all state alid <br />federa� Occupationai Safety and Health Act regulations; especially ihe federal Hazardous <br />Waste Qperations and Emergency Response standards under Code of Federal Regulations, <br />title 29, sections I9I O:I20 and 1926.65. <br />5. 1'repare payment requ�st farrns and provide all back up dncumentation as required by the <br />MetropoliEan Cour�cil for submittal by the City. <br />6. Prepare required LCDA and TBFtA grailt annual report, fnal report; and certificate of <br />expenditures, pursuant to Metropolitan Council requirements for submittal by the City. <br />7. Prepare required asbestos and lead abatemeni final reports as �dentified in Exhibit B a�d <br />provide a copy of these reports to the City. <br />
