Temparary outside display and sale of inerchandise++��} outside a building ar protective structure <br />may be established for up to thirty ��(30) consecutive calendardays a year after the issuance of a <br />temporary display/sales permit by the Community Development Directar ar <br />designee, using the criteria set forth in subsection 3�in any of the following business districts where <br />retail sales are allowed: B-2, B-3, B-4 and shopping center districts. A single temporary display sign� <br />tenant, not to exceed twenty (20) square feet, within ten feet (10') of the sales area, and with property owner <br />approval, may be placed on a wall or solid surface far the tliiity f1�#h+e (�30) day temparary sale. A site <br />plan indicating the location of the sales area and sign shall be provided to the city for review and approval. <br />3. Incidental ar seasonal sales, such as produce, nursery, ar greenhouse sales, including an accessory <br />structure may be permitted after issuance of a seasonal sales permit far a period not to exceed ninety (90) <br />calendar days, after review of the following criteria submitted with the permit application: <br />a. The amount of outside sales area compared to the amount of inside sales space. <br />b. Location of the outside sales area and the extent it encroaches on required setbacks. <br />a Impact on traffic, �� pedestrian circulation, and emernencv response on the site. <br />d. Impact on parking on the site. <br />e. The height of inerchandise displays. <br />£ The hours which merchandise is displayed. <br />g. The type of inerchandise to be displayed. <br />h. Incidental ar seasonal display signage, to a maximum of seventy five (75) square feet in area, shall be <br />placed on a solid surface or attached to a solid surface for the term of the display. <br />i. Accessory structures used in incidental ar seasonal displays shall meet all applicable fire codes and <br />parking lot setback requirements. (Ord. 1238, 3-13-2000) <br />4. The outside display of inerchandise, except as covered in subsections 6E1 E2, and 6E3� of this section, <br />is permitted by conditional use permit. When considering any such conditional use permit request, the <br />planning commission and city council shall consider the following criteria to determine the impact of the <br />proposed outside display on the site, adjacent properties and the community as a whole: <br />a. The amount of outside sales area compared to the amount of inside sales space. <br />b. Location of the outside sales area and the extent it encroaches on required setbacks. <br />c. Impact on traffic &pedestrian circulation. and emeraencv reswnse on the site. <br />d. Impact on parking on the site. <br />e. The height of inerchandise displays. <br />f. The hours in which merchandise is displayed. <br />g. The type of inerchandise to be displayed. <br />5. The issuance of a conditional use permit for the outside display of inerchandise shall not cause <br />nonconforming sites to be brought into conformance with all code requirements, ar the dedication of street <br />rights of way. (Ord. 1091, 5-28-1991; amd. 1995 Code; Ord. 1238, 3-13-2000) <br />F.WProcess And Equipment Limitations: Processes and equipment employed and goods processed or sold shall <br />be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, noise, <br />vibration, refuse matter or water-carried waste. <br />G.�. Buffer Zone Between Business And Residence District: Where a business district abuts a residence district, <br />any new development shall include a landscaped buffer zone. There shall be a protective strip of land not <br />less than ten feet (10') in width. This protective strip shall contain no structures, shall not be used far <br />parking, off-street loading ar starage. �+d-�be �w�c�•The landscape treatment shall include a <br />compact screen wall ar fence but shall not extend within fifteen feet (15') of the street right of way. The <br />planting ar fence design must be approved by the .�M}��aia��iE Community Development Directar ar <br />designee as being in harmony with a residential neighborhood and providing sufficient screening of the <br />commercial area.
