e. Impact on the general public health, safety and welfare:
Use of the SuperAmerica site as an off-sale liquor store will not have an impact
on the general health, safety, and welfare of neighboring residents and land
owners. The Community Development Department has concludedthat the
impression that this liquor store will create added crime, public drunkenness, and
pedestrian conflict with impaired drivers cannot be reasonably validated. There
are no reports or existing crime statistics from this site or other off-sale liquor
sites.
Based on this, staff concludes that this added new use and 100 new trips will not
impact the general public health, safety and welfare of the surrounding
neighborhood, nor the City of Roseville.
f. Compatibilitywith the City's Comprehensive Plan:
Use of the SuperAmerica site as an off-sale liquor store is compatible with the
Roseville Comprehensive Plan. Specifically, the Roseville Comprehesive Land
Use Plan identifies this site as "Business" use which an off-sale liquor store is an
appropriate use. Further, the Comprehensive Plan does not specificall limit this
site to limited types of business, commercial, or retail uses.
NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the
request by Speedway SuperAmerica for a CONDITIONAL USE PERMIT in accordapce with
Section 1013.01 of the Roseville City Code, subject to the following conditions;
L The off-sale liquor portion of the convenience store being limited to aize of
2,200 square feet.
2. The separate liquor store entrance must be from the east side of the building.
3. The parking and island area located on the south side of the structure ust be
modified so that all stalls face north (as per Consultant's report of Dermber 18,
2003).
4. The review and approval of a building permit for renovations must be onsistent
with the approved conditional use permit plans.
5. Because this store is adjacent to existing residential dtr lu f
operation and delivery being limited to standard hours of "stand slr, liu,f
store operations, with the liquor store closingby 8 pm. Monday Rrough
Thursday, and by 10 pm Friday and Saturday.
