An ex�ansion of a pre-existing residential principal or accessory structure in an R-1 or <br />R-2 zonin dis�tr'ict which maintains the same property line setbacics and structure <br />se�arations �rovided there is no further encroachment of anv non-conforming structural <br />dimension or increase in the non-conformitv of use of the land . <br />2. A nre-existin� �rinci�al or accessory structure, including expansion thereof, in which a <br />progertv line setbacic dimension has been made revised and made substandard� eminent <br />domain or other formal nublic asencv action. Such a structure shall be considered a <br />le�all� conforming structure. All future additions to the structure or use shall meet the <br />reauired setbacic (at that timel from the revised property or easement line. <br />1011.03: DAMAGED NONCONFORMING STRUCTURE: <br />1� Any nonconforming structure damaged to an extent of not more than fifty percent (50%) of its <br />y� reproduction cost by fire, flood, explosion or other casualty may be reconstructed and used as <br />�� before if such reconstruction is completed within six (6) months of the casualty. If the damage to <br />ifi the structure is greater than fifty percent (50%) of the replacement cost of the structure at the <br />1� time of loss, as determined by the City Council, the reconstruction shall be in accordance with <br />X� this Code. (Ord. 881, 6-1-81; amd. 1995 Code) <br />�� 1011.04: DISCONTINUED NONCONFORMING USE: <br />20 Whenever a nonconforming use shall have been discontinuedfor a period df &twelve (612) I <br />21 months, it shall not return to the original or any other use which is nonconforming. (Ord. 881, 6- <br />22 1-81) <br />23 1011.05: MAINTENANCE OF NONCONFORMING STRUCTURES: <br />24 Normal maintenance of a structure containing or which is a nonconforming use is permitted, <br />25 including necessary nonstructural repairs and incidental alterations which do not � expand <br />26 the foundation and/or building size, increase the building occupancv or �arlcing demand, or <br />27 intensify the nonconform�rgity of the structure or use.
