REQUEST FOR COUNCIL ACTION <br />DATE: 02/09/04 <br />Item Number: 3.14 <br />Department ApprovaL• Manager Reviewed: Agenda Section: <br />�—.ti Consent Agenda <br />� <br />� <br />Description: Consideration of Waiving Statutory Liability Limits <br />Background <br />Minnesota Statute 466.04 states that liability of any municipality on any one claimant shall not <br />exceed $300,000 when the claim is for death, wrongful act, or omission and shall not pay more <br />that $1,000,000 for claims arising out of a single occurrence. <br />A city has the opportunity to waive the individual statutory limit. By waiving the statutory limit, <br />there is no limit on the settlement a claimant(s) may receive. <br />Financial Implications <br />Waiving the statutory limit will increase the policy premium and increase the amount of <br />settlement a claimant(s) may receive. <br />Staff Recommendations <br />Staff is recommending that the City Council does not waive the monetary limits on municipal <br />tort liability established by Minnesota Statute 466.04. <br />Council Action <br />Motion to approve not waivin� the monetary limits on municipal tort liability established by <br />Minnesota Statutes 466.04. <br />
