��� <br />�{� <br />Memo <br />To: Mayor and Council, <br />Neal Beets, City Manager <br />From: Chris Miller, Finance Director <br />Date: February3,2004 <br />Re: On-Sale Liquor License Limitations <br />Date: 02/09/04 <br />Item: S� <br />Liquor Licenses <br />Background <br />At the January 12, 2004 City Council meeting, the Council gave direction to Staff to develop <br />legislation that would seek an increase in the City's on-sale liquor licenses. The amount of on- <br />sale liquor licenses is restricted by State Statute. Subsequent to that meeting, Staff learned that <br />the laws regarding the limitation of on-sale liquor licenses were loosened in the 2003 Legislative <br />Session. This information was communicated to the Council in the City Manager's Report, <br />dated January 27,2004. <br />The revised definition of on-sale liquor licensees now refers to liquor-only establishments, and <br />does not include restaurants. By this new definition, Roseville still has 30 available on-sale <br />liquor licenses. By City Code, a restaurant is defined as: <br />1� If the establishment provides seating for [�s� than 174 patrons: <br />gross sales must be attributable to food service. <br />2) If the establishment provides seating for more than 174 patrons <br />gross sales must be attributable to food service. <br />at least 50% of <br />at least 25% of <br />Special Requirements for Bars, Nightclubs, and Bowling Alleys <br />Our current Zoning Code does not permit liquor-only establishments. An establishment wishing <br />to obtain an on-sale liquor license independent of minimum food sales, would need to seek a <br />change to the Zoning Code. This requirement would likely apply to bars, nightclubs and <br />bowling alleys. <br />Questions? <br />Questions requiring the process to change the Zoning Code should be directed to Dennis Welsch <br />at 651-792-7071.
