Front Yard Setback: Where adj acent structures have front yard setbacks different from those required, the <br />front yard setback sha11 conform to the average setback of the adjacent structures. If only one adjacent 1ot is <br />occupied by a structure, the front yard setback sha11 be the average of the required setback and the setback <br />of that adjacent structure. (Ord. 275, 5-12-1959) <br />2. Side Yard Setback:. When a side yard adjoins a residential district, the setback sha11 not be used for <br />parking or loading. Where a side yard faces a street (corner 1ot), the side yard setback sha11 be thirty feet <br />(30'). Where such a corner 1ot side yard faces a residential district across the street, screening sha11 be <br />provided as speci�ied in subsection G of this Section. (Ord. 878, 3-23-1981) <br />3. Rear Yard Setback; Screen Wa11. Where the rear yard adjoins a residential district, a screen wall of six <br />feet (6') but not more than eight feet (8') in height sha11 be installed and maintained by the owner of the <br />business parcel to effectively inhibit eye 1eve1 vision between residential and business areas. <br />F1oor Area Ratio: Subject to a11 other provisions of the code and setbacks, the floor area of <br />building and 1ot area in a11 business districts sha11 not be greater than 1.0. A11 business, storage, service, repair, processing or merchandising display sha11 be conducted wholly <br />within a building or behind a solid fence not less than six and one half feet (6'- 6") or nor more than eight <br />feet (8') high adjacentto residential districtsto completely screen the activity or storage, except for the <br />following uses and in accordance with the conditions herein speciiied. <br />a. Off-street parking and loading where permitted as accessory uses. <br />b. Display of automobiles and trucks where accessory to authorized principal uses. (Ord. 1091, 5-28- <br />1991; amd. 1995 Code) <br />2. Temporary outside display and sale of inerchandise outside a building or protective structure may be <br />established for up to thirty (30) consecutive calendar days a year after the issuance of a temporary <br />display/sales permit by the Community Development Director or designee, using the criteria set forth in <br />subsection 3 below in any of the following business districts where retail sales are allowed: B-2, B-3, B-4 <br />and shopping center districts. A single temporary display sign per tenant, not to exceed twenty (20) square <br />feet, within ten feet (10') of the sales area, and with property owner approval, may be placed on a wall or <br />solid surface for the thirty (30) day temporary sa1e. A site plan indicating the location of the sales area and <br />sign sha11 be provided to the city for review and approval. <br />3. Incidental or seasonal sales, such as produce, nursery, or greenhouse sales, including an accessory <br />structure may be permitted after issuance of a seasonal sales permit for a period not to exceed ninety (90) <br />calendar days, after review of the following criteria submitted with the permit application: <br />a. The amount of outside sales area compared to the amount of inside sales space. <br />b. Location of the outside sales area and the extent it encroaches on required setbacks. <br />c. Impact on traffic, pedestrian circulation, and emergency response on the site. <br />d. Impact on parking on the site. <br />e. The height of inerchandise displays. <br />£ The hours which merchandise is displayed. <br />g. The type of inerchandise to be displayed. <br />h. Incidental or seasonal display signage, to a maximum of seventy five (75) square feet in area, sha11 be <br />placed on a solid surface or attached to a solid surface for the term of the display. <br />i. Accessory structures used in incidental or seasonal displays sha11 meet a11 applicable �ire codes and <br />parking 1ot setbackrequirements. (Ord. 1238, 3-13-2000) <br />4. The outside display of inerchandise, except as covered in subsections E1 E2, and E3 of this section, is <br />permitted by conditional use permit.
