Regular City Council Meeting — 02/09/04
DRAFT Minutes - Page 8
Councilmember Schroeder used Consent Agenda Item 3.2
as an example of the confusion, with having three (3)
options "approve (modify or deny)" for the ordinance.
City Manager Beets responded that if the item was on
Consent for Approval it was on Consent for Approval; if a
councilmember wanted to modify or deny a Consent
approval item, they should take it off Consent. But that no
councilmember had suggested they wanted to modify or
deny these items when they were previously before the
Council.
Mayor Klausing clarified future staff report wording for
recommending approval would include the requested
action to approve, and the Council would reserve the
authority to modify or deny, at which time it would be
removed from the Consent Agenda.
Councilmember Kough addressed his concerns related to
zoning issues and a future bowling alley use.
Community Development Director Dennis Welsch
clarified that for a bowling alley at HarMar, a Conditional
Use Permit would be required in a B-2 Zone, but the issue
at HarMar had been related to the lease, and was not
applicable to Land Use regulation.
John Kysylyczyn, 3083 Victoria Avenue N
Mr. Kysylyczyn expressed confusion about which item
was applicable for current Council discussion, and
reviewed historical agendas and Council Rules and
Procedures for Ordinance and Resolution approvals; and
the need for 4/5 approval on Summary Ordinances.
Mr. Kysylyczyn spoke regarding Item 3.9 related to
Shopping Center Zoning Districts; referring to page three
of the staff report (Planning Commission comments)
regarding applicable rules for specific shopping centers;
and encouraged the Council to take a leadership role and
resolve the inconsistency in this portion of the zoning
code.
