Jeff Evenson <br />February 13,2004 <br />Page 4 <br />was not on any of the other documentation provided to the City by PhenCon and is covered up <br />to 38¢ per square foot. <br />I also asked Mr. Edwards about settlement compensation for the removal and disposal <br />of the existing roo£ He indicated that the settlement award for roof replacement included the <br />cost of complete removal and disposal of the existing roof as well as the construction of a like- <br />kind roo£ In this context, you and I also discussed that one of the requirements to receive <br />settlement compensation is that the building owner retain any decking removed and replaced <br />on the construction site for 30 days after removal. <br />With regard to next step in the process to get settlement compensation, I am having Mr. <br />Edwards send zxie a copy of the Acc�ptance of Settlement, Covenant to Remediate and Release <br />of All Settled Claims form for the Roseville Ice Arena, as well as a Request for Extension <br />form. Once the City signs the Acceptance of Settlement, the City will receive within 5 days <br />50% of the depreciated roof award and then has 60 days to remediate the deck and replace the <br />roo£ However, the City can immediately apply for an extension to this time period-based upon <br />its specific needs, namely the need to do the work during the August shutdown. I will forward <br />the Acceptance of Settlement forms and the Extension forms to you as soon as I receive them. <br />You and I also briefly discussed the relationship between the contractors and <br />consultants, and the advantages/disadvantages of the City contracting with contractors ancUor <br />consultants with experience under the settlement. You indicated that you would be continuing <br />to gather more information from your contacts for use in the bidding process. As I indicated in <br />our conversation, we would be happy to review any bid documents or specifications at your <br />request. <br />I believe this summarizes the main topics of our telephone conversation.
