Constitutional Rights <br />Equal Protection t 1�� Amendmentl:_ <br />• A government action may not unduly favor one <br />group over anotherand may not discriminate <br />against any individual, either directly or <br />indirectly. <br />[Note: Wherethis comes up in planning and <br />zoning is when local governmentsclassify <br />(define) uses for the sake of regulation — must <br />always considerothers with similar <br />characteristics.] <br />Definition: "Comqrehensive Plan" <br />• The documentand maps that memorialize <br />the planning process, goals, policies, and <br />action steps to realize the community's <br />desired future. This is a vitally important <br />legal document in that it provides the <br />legal foundation for the use of the police <br />powers of the local government. <br />ZONING <br />Zonina Ordinance: <br />• The document that contains the provisions and <br />standards to effectuatethe officialzoning maps. <br />In additionto establishingthe community's <br />authorityto enforcezoning, the ordinance <br />contains definitions, establishesprocedures, <br />and defines the purpose and standards (rules) <br />for each zoning district. <br />• Once a community has adopted a zoning <br />ordinance, all propertywithin its corporate limits <br />are subject to its provisions. <br />Comprehensive Planning: <br />• The process through which the community <br />analyzes its opportunities and constraints <br />and establishes goals and a vision for its <br />future and determines and adopts the <br />action plans to implementthe plan. <br />ZONING <br />Official Zonina Map: <br />• If a community intends to enforce zoning it <br />must have an official zoning map. This <br />map establishes zoning districts. Each of <br />these districts is created to perform a <br />distinct purpose and aggregate particular <br />land uses together. <br />Planned Unit Development (PUD) <br />• A zoning tool that is designed to authorize <br />flexibilityin setbacks, lot size, and other <br />performance standards. PUD is a <br />separate"floating"zoning districtthat may <br />be applied for anywhere in the City of <br />Roseville. <br />
