City Council Study Session — 03/15/04 <br />Draft Minutes - Page 9 <br />• Authorize staff to proceed with necessary fieldwork to <br />assemble feasibility drawings, alignment and costs for <br />Council action/approval <br />• Explore burial of electric distribution lines <br />City Attorney Squires and staff were directed by Mayor <br />Klausing, with Council majority consensus to review past <br />Council meeting minutes and information to determine the <br />existence, the status and conditions of the "moratorium" on <br />pathway construction previously considered by the City Council. <br />Councilmember Schroeder addressed the moratorium that he <br />believed had been enacted during the 2004 budget discussions. <br />City Attorney Squires noted that his office could review past <br />action of Council; the status of any moratorium on pathway <br />construction; and options for Council to change their previous <br />action. City Attorney Squires recommended that following his <br />review of that information, he inform staff directly on whether <br />they should proceed as directed. <br />Public Works Director Schwartz sought clarification regarding <br />the Council's direction; with the majority of Councilmembers <br />concurring that staff be directed to proceed as requested. <br />Councilmember Schroeder requested that the proposed directive <br />to staff for proceeding with a feasibility study on the proposed <br />County Road �2 Regional Trail project be recorded in motion <br />form. <br />Maschka moved, Ihlan seconded, authorizing staff to hold public <br />information meetings, proceed with necessary field work to <br />assemble feasibility drawings, alignment and costs for Council <br />action/consideration; and to explore the burial of electric <br />distribution lines; pending recommendation of the City Attorney <br />related to the moratorium. <br />Roll Call <br />Ayes: Ihlan, Kough, Maschka and Klausing. <br />Nays: Schroeder. <br />
