Property Access. <br />a) Lessee, at all times during this Lease, shall have vehicle ingress and egress over the <br />Property by means of the existing access, subject to notice requirements to Owner as set <br />forth in Section (b) below. <br />b) Lessee, at all times during this Lease, shall have access to the Property in order to install, <br />operate, and maintain its Antenna Facilities, 24 hours per day, 7 days per week. Lessee or <br />its employees, agents, or subcontractors will be required to sign-in before entering onto the <br />properiy. Owner will be responsiblefor determining the sign-in location. <br />c) Lessee is also granted the right, at its sole cost and expense, to enter upon the Owner's <br />properiy to determine the properties suitability for any intended use of Lessee, which <br />studies may include surveys, environmental evaluations, radio wave propagation <br />measurements, field strength tests and such other studies as Lessee deems necessary or <br />desirable. <br />9. Utilities. Owner represents to the best of its knowledge, that utilities adequate for <br />Lessee's use of the Properiy are available. Lessee will pay for all utilities used by it at the <br />Properiy. Owner will cooperate with Lessee in Lessee's efforts to obtain utilities from any <br />location provided by Owner or the servicing utility. <br />10. Personal Propertv and Real Estate Taxes. Lessee will be responsible for payment of all <br />personal properiy taxes assessed directly upon and arising solely from its use of the <br />conununications facility on the Site. Lessee will pay to Owner any increase in real properiy taxes <br />attributable solely to any improvements to the Site made by Lessee within 60 days after receipt of <br />satisfactory documentation indicating calculation of Lessee's share of such real estate taxes and <br />payment of the real estate taxes by Owner. Owner will pay when due all other real estate taxes <br />and assessments attributable to the properiy of Owner of which the Site is a part. Owner shall <br />provide to Lessee a copy of any notice, assessment or billing related to real estate or personal <br />properiy taxes for which Lessee is responsible under this Agreement within ten (10) days of <br />receipt of the same by Owner. Lessee shall have no obligation to make payment of any real <br />estate or personal properiy taxes until Lessee has received the notice, assessment, or billing <br />related to such payment as set forth in the preceding sentence. In the event Owner fails to <br />provide to Lessee a copy of any real estate tax notice, assessment, or billing within the ten (10) <br />day period set forth herein, Lessee shall be relieved of any obligation or responsibility to make <br />payment of real estate taxes referred to in the notice, assessment or billing which was not timely <br />delivered by Owner to Lessee. <br />Lessee shall have the right, at its sole option and at its sole cost and expense, to appeal, <br />challenge, or seek modification of any real estate tax assessment or billing for which Lessee is <br />wholly or partly responsible for payment under this Agreement. Owner shall reasonably <br />cooperate with Lessee in filing, prosecuting, and perfecting any appeal or challenge to real estate <br />taxes as set forth in the preceding sentence, including but not limited to, executing any consent to <br />appeal or other similar document. <br />����rt � <br />
