SECTION VIII <br />NON-ASSIGNABILITY <br />BIG 10 recognizes that this Agreement for concession services cannot be transferred, <br />assigned or subcontractedby BIG 10. <br />SECTION IX <br />IDENTIFICATION OF PERSONNEL <br />BIG 10 shall provide appropriate identification of its agents, employees and <br />representatives during the performance of this Agreement at the RSC. BIG 10 <br />acicnowledges and recognizes that it is a fair and equal opportunity employer and that its <br />employees, representatives and agents have had training in sexual harassment, gender <br />sensitivity and cultural diversity. <br />SECTION X <br />WORKERS' COMPENSATION <br />By executing this Agreement, BIG 10 certifies that they have reviewed the provisions of <br />the Minnesota Statutes with respect to worlcers' compensation, and BIG 10 restates that it <br />is an independentcontractor and certifies that BIG 10 will comply with the provisions of <br />the performance of worlc under this Agreement. <br />SECTION XI <br />INDEMNITY <br />BIG 10 shall indemnify City against any and all losses, liabilities, damages, costs and <br />expenses, (including costs of defense, settlement and reasonable attorney's fees by reason <br />of liability imposed by law upon City) for damages as a result of bodily injury, including <br />
