Department of Health HLanan Services 2(}p0); and <br />WHEREAS, nine out of ten non-smokers are ox�osed to �'�S at loast anc� every 2 to 3 <br />days (Joumal of the P�nerican Medical Association, January 1998); and <br />WHEREAS, sitting in a smoke-freesection of a reataumnt for twp h�ur� is like srnoking <br />1'/s ci$arettes (Prest�tation by Katherine Hammond, I'hD, University of California School <br />of Public Hcalth); and <br />NOW, THEREFORE IT BE ORDAINED,The R�.msey County Board of <br />Commissioners hereby app�ovas the Ramsey County Smoke-Free Restaurant <br />Ordinance: <br />SECTION l. ,Tj�jg: <br />This ordinance shall be known and refcr�nccd as tha Ramsey County Smokc-Free Restaurant <br />Ordinance. <br />SECTION 17. Jor�dkt�oa: <br />Subsection 1. 'Il�e purpose of this ordinance is to protect the health, safety, and ganot'al <br />w�lfare of the people � Rainsey County pursuant to the powers granted under Minnesota <br />Statutes, chapters 145A and 375, and the Home Rule Chaztcr for R�mn.sey County. <br />S�abseetion 2'�ris ordinance applies throughout all of l�s.msey County, <br />Subseetion 3, Nothing m this ordinance sh�ll prevent other local levels of government, within <br />Rainsey County, fran adopting more restrictive measures to protect citizens from second-hand <br />smoke. <br />SECTION III. ns: <br />S�abseetion 1. Bar means any Establishmentthat has: a) an on-sale intoxicating liquor liccnso, <br />�n on-sale non-intoxicatingmalt liquor license, � on-sale 3.2 percentmdlt liquor license, a <br />wine license and/or strong beer liquor [ic�nse'issued by the State of Minnesota, the <br />municipality within which it is loca�ed, or Rainsey County; and b) whosa sales of intoxicating <br />liquor, non-intoxieating �It liquor, 3.2 percent malt liquor, wine, and beer is projected for an <br />initial licensee to be - or is demonstrated for an existing licensee to be � xn�e than 50 % <br />(percent) of the total of net sales of f�Cl and beverages, after taxes that are served in the <br />Establishment. These are the sales reporte�i to Federal and/or State Revenue Authorities fran <br />the rncst recont liquor licensing year.
