SEC. 12.80. �] DEFINITIONS. <br />The followina words and terms, when used in this Division, shall have the followina meaninqs <br />unless the context clearlv indicates otherwise: <br />Bar — a portion of an establishment where a person can purchase and consume alcoholic <br />beveraaes. <br />Office — a buildina, structure or area used bv the �eneral public or servina as a nlace of work at <br />which princiqal activities consist of professional, clerical or administrativeservices. An office includes, but <br />is not limited to. professional offices. offices in financial institutions. business offices. telemarketina offices <br />and qovernmental offices. <br />Other Person in Charqe — the aqerit of the proprietorauthorizedto �erform administrative <br />direction to and aeneral supervision of the activitieswithin a place of work and �ublic place at anv piven <br />time. <br />Place of Work — anv enclosed, indoor location at which two or more individuals perform anv tvoe <br />areas of an office, a�ublic convevance, a factorv. a warehouse, a hotel or motel. and other locations <br />where services are perFormed under an emqlovment relationshia. Enclosed. indoor areas of orivate <br />clubs. and rooms used for private meetinas or social functions. are "�laces of work" if two or more <br />persons actina under an emplovment relationshio �rovide cleanina. caterina. food or beveraae service. <br />maintenance or other supao►t services in the location. <br />Proprietor — the �artv. reaardless of whetherthe �artv is the owner or lessee of the place of work <br />or public place, who ultimatelv controls. aoverns or directs the activities within the olace of work or oub�ic <br />place. The term "proprietor" mav applv to a corooration as well as an individual. <br />Restaurant — a food and beveraae service establishment. whetherthe establishment serves <br />alcoholic or nonalcoholic beveraaes. <br />Smokina — the inhalina, exhalina or combustion of anv ciaarette, ciaar. o�e or anv other liahted <br />smokina eQUipment. Smokina includes carrvina a liahted ciaarette, ciaar. oio� or anv other liahted <br />smokina epuipment. <br />SEC. 12.81. �R�EG] PROHIBITIONS. <br />ra� Except as provided in subsection (c). no �erson shall smoke in oublic places and olaces of work. <br />includina outdoor and bar areas of restaurants. The qroprietor of an outdoor dinina area or outdoor <br />bar area of a restaurant mav desianate for smokina � to fiftv percent (50%1 of the outdoor seating <br />capacitv of the restaurant provided this location is aapropriatelv sianed as a smokina area. <br />(c) The prohibitions of this Section do not app� to: <br />L �� Private residences. <br />(2) Motor vehicles. <br />t31 The use of tobacco as Dart of a traditional Indian spiritual or cultural ceremonv. <br />(41 Sleepin4 rooms of hotels and motels which are rented to auests. <br />SEC. 12.82. �, FhP518ti OF PROPRIETORS. <br />The proprietor or other person in charae of a public place or �lace of work where smokina is <br />prohibited shall: <br />fa1 Post'nonsmokina" sians that com�lv with the Minnesota Clean IndoorAir Act Rules.
