City Council Regular Meeting — 08/23/04 <br />DRAFT Minutes - Page 10 <br />Councilmember Ihlan further addressed whether <br />neighboring property owners would be seeking easements, <br />and noted that the easement line would become the <br />dividing property line; and sought Council commitment <br />that future decisions related to easement vacation would <br />include consideration of the perspective of retaining <br />existing open space. <br />Mr. Welsh opined that staff anticipated applications from <br />two neighbors and confirmed that the easement line would <br />become the property line. <br />Mr. Welsch noted that the Parks and Recreation <br />Department is always consulted and involved in the <br />decision-making process related to land-use issues; and <br />noted that this area had not been identified on any parks <br />maps for open space, trail or park land development. Mr. <br />Welsch further noted that staff continued to work from <br />current policy pending that policy being revised by City <br />Council and staff so directed. <br />City Manager Beets noted that the requested action tonight <br />was for the express purpose of vacating the easement, the <br />retention of which staff had determined was not necessary. <br />Councilmember Kough sought recourse to require property <br />owners to maintain land if and when vacated by the City to <br />them {i.e., boulevards and ditches). <br />Ms. LeTendre, property owner at 386 Wagner Street, was <br />in attendance, and noted that her family had been <br />maintaining the easement for 25 years. <br />Roll Call <br />Ayes: Ihlan, Schroeder, Maschka, Kough and Klausing. <br />Nays: None. <br />5.
