City Council Regular Meeting — 08/23/04
DRAFT Minutes - Page 10
Councilmember Ihlan further addressed whether
neighboring property owners would be seeking easements,
and noted that the easement line would become the
dividing property line; and sought Council commitment
that future decisions related to easement vacation would
include consideration of the perspective of retaining
existing open space.
Mr. Welsh opined that staff anticipated applications from
two neighbors and confirmed that the easement line would
become the property line.
Mr. Welsch noted that the Parks and Recreation
Department is always consulted and involved in the
decision-making process related to land-use issues; and
noted that this area had not been identified on any parks
maps for open space, trail or park land development. Mr.
Welsch further noted that staff continued to work from
current policy pending that policy being revised by City
Council and staff so directed.
City Manager Beets noted that the requested action tonight
was for the express purpose of vacating the easement, the
retention of which staff had determined was not necessary.
Councilmember Kough sought recourse to require property
owners to maintain land if and when vacated by the City to
them {i.e., boulevards and ditches).
Ms. LeTendre, property owner at 386 Wagner Street, was
in attendance, and noted that her family had been
maintaining the easement for 25 years.
Roll Call
Ayes: Ihlan, Schroeder, Maschka, Kough and Klausing.
Nays: None.
5.
