City Council Regular Meeting — 09/13/04 <br />DRAFT Minutes - Page 16 <br />zoning code defining shopping center designation and the <br />inconsistency of that zoning with application of the current <br />Target structure or proposed redevelopment. Based upon that <br />review, staff and Planning Commission by unanimous vote, was <br />recommending the requested amendments to the City's <br />Comprehensive Plan and zoning code. <br />Mr. Paschke reviewed the other components of the requested <br />action or Council consideration. <br />Councilmember Ihlan questioned the need for an amendment to <br />the Comprehensive Plan map designation and her rationale in <br />preferring the definition of shopping center district of the <br />Comprehensive Plan. Councilmember Ihlan recommended that <br />if there was inconsistency, the Zoning Code should be amended <br />to be consistent with the Comprehensive Plan. <br />Mr. Paschke, in his review of the application, concluded that <br />when an existing use was not consistent, the Comprehensive Plan <br />would be amended to be consistent with the land use, rather than <br />rezoning the property. <br />Councilmember Ihlan continued review and her interpretation of <br />the zoning code and Comprehensive language; supporting the <br />City's control through the Comprehensive Plan and the need to <br />protect the public interest with respect to major retail facilities; <br />and the need to make the zoning code more clear. <br />Mayor Klausing requested comment from City Attorney <br />Anderson. <br />City Attorney Anderson concurred with staff on their <br />interpretations. Mr. Anderson noted that the Comprehensive <br />Plan contained broad statements, but that the rules and <br />regulations were applied through the zoning code. Mr. Anderson <br />further defined the Comprehensive Plan as a guidepost, not a <br />law; and when the need arose to make them consistent, it was <br />appropriate to amend the Comprehensive Plan. <br />City Attorney Anderson reviewed various and applicable <br />sections of the City Zoning Code and reviewed definitions of <br />Resolution 10242 <br />Easement Vacation <br />1515 West County <br />Road B <br />Ordinance 1310 <br />Zoning 1515 <br />County Road B and <br />2194 State Farm <br />Road <br />
