City Council Regular Meeting — 09/13/04 <br />DRAFT Minutes - Page 24 <br />City Attorney Anderson reviewed legal standards. <br />Discussion ensued regarding Target Corporation's due diligence <br />in obtaining a clean plat; State Farm Road; traffic flow in <br />neighborhood and future flexibility; possible one-way for Pascal; <br />and the public improvement agreement for public roadways. <br />Roll Call <br />Ayes: Maschka, Kough, Schroeder and Klausing. <br />Nays: Ihlan. <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 9:14 p.m. <br />and reconvened at 9:25 p.m. <br />9. Consider the Request of United Properties for a Final Plat, <br />Rezoning, and Final Planned Unit Development (PUD) for a <br />33-Unit Condominium on the West Side of the Entrance to <br />Midland Hills Country Club at Fulham and County Road B <br />City Planner Thomas Paschke reviewed this request for <br />development of the northeast corner of Fulham and Roselawn <br />Avenues. <br />Councilmember Ihlan questioned who had made the <br />determination that an environmental assessment did not need to <br />be performed. <br />Mr. Paschke <br />based on the <br />laws. <br />advised that staff had made the determination <br />concept plan process and current environmental <br />Mayor Klausing noted that this issue had come up with past <br />projects, questioned whether this was discretionary. <br />Mr. Paschke noted that that this case was not discretionary and <br />had been a staff determination. <br />Brian Kerry, United Properties, Applicant <br />Mr. Kerry noted that the plan before the City Council tonight <br />was consistent with previous presentations; plans were to break <br />Ordinance 1311 <br />Final Plat, <br />Rezoning, and <br />Final PUD for <br />Midland Hills <br />Country Club <br />
