City Council Regular Meeting — 09/27/04 <br />DRAFT Minutes - Page 16 <br />and reconvened at 7:09 p.m. <br />9.5 Twin Lakes Redevelopment Project, Error in Publication of <br />Legal Notice <br />Councilmember Ihlan had requested two additional items, as <br />previously noted, related to the Twin Lake Development process. <br />Ms. Ihlan noted that she had received numerous contacts from <br />residents who had received notice of a Public Hearing at the <br />Planning Commission Meeting of October 6, 2004; but then an <br />additional notice had been received regarding another Public <br />Hearing at a Special Planning Commission Meeting scheduled <br />for October 14, 2004, apparently due to a staff error and inability <br />to meet legal published notice requirement timelines. <br />Councilmember Ihlan sought clarification and Council input as <br />to the process proposed by staff. Councilmember Ihlan opined <br />that attempting to hold two Public Hearings rather than one <br />would confuse the public and serve to allow public comments to <br />lose their impact for Planning Commission members. <br />Mayor Klausing questioned Councilmember Ihlan's concerns <br />regarding holding two hearings, noting this was consistent with <br />previous comments she had made supporting additional public <br />comment opportunities. <br />Councilmember Ihlan defended her position that future court <br />challenges could be realized by the City if proper notice and <br />procedure were not followed. Councilmember Ihlan <br />recommended that re-notice be provided by staff, properly <br />noticed for October 14, 2004, with the scope of the notice being <br />expanded. <br />City Manager Beets requested the Council hear comment from <br />City Planner Thomas Paschke and City Attorney Scott Anderson <br />related to what transpired and staff's correction of the error. <br />City Planner Paschke noted that, prior to the actual notice not <br />making publication in the City's legal newspaper, the Roseville <br />Review, to meet legal requirements as indicated by state law and <br />the intent of that state law, he and the Planning Commission <br />Chair Bill Mulder had discussed holding a Special Planning <br />Twin Lakes <br />Redevelopment <br />Project, <br />Legal Publication <br />Error <br />
