City Council Regular Meeting — 09/27/04 <br />DRAFT Minutes - Page 30 <br />and accountability. <br />Kough moved to direct the City Attorney to prepare a draft <br />resolution for Council consideration, establishing a policy to <br />limit Department Heads as responsible for purchases and for <br />authorizing employees to make purchases; and that the <br />Department Heads closely monitor those purchases; and that in <br />the case of emergency payments, the Mayor and two City <br />Councilmembers authorize such purchases. <br />Councilmember Ihlan sought clarification from the maker of the <br />motion regarding his intent. <br />City Attorney Anderson questioned the legality of the proposed <br />motion, given the regulatory provisions provided for Statutory <br />Plan B Cities and authority given to the City Manager in that <br />form of government. City Attorney Anderson noted that, while <br />the City Council has the right to set up auditing procedures, the <br />City Manager has the right to keep the city running on a day-to- <br />day basis by making payments, citing Minnesota Statute <br />412.691. <br />Further discussion including reporting procedures and detailed <br />summaries; compliance with law versus comfort level of <br />Councilmembers with policies for internal controls; and whether <br />those controls are adequate and being followed. <br />Councilmember Schroeder spoke in opposition to <br />Councilmember Kough's proposed motion. <br />Councilmember Kough withdrew his original motion. <br />Ihlan moved, Schroeder seconded, directing staff at the next <br />Council Study Session to include materials and information for <br />discussion and review of current check and purchasing card <br />purchasing and disbursement policies and procedures for City <br />Council familiarization; and discussion of potential amendments <br />that the Council may wish to consider to those policies and <br />procedures. <br />Roll Call <br />Ayes: Ihlan, Kough, Schroeder and Klausing. <br />
